As a Trustee you have a fiduciary responsibility to act in the best interests of the beneficiaries while following the instructions provided by the Grantors. In this scenario Bart should almost certainly follow the Grantors’ instructions. It could be possible that if Bart distributes funds and ignores the wishes of the Grantors and Smithers then goes on a blind drug infused rampage spending all of his money, then Smithers may have a claim of essentially “you knew I couldn’t handle this much money”. Lisa may also have some claims against Bart for not following the rules, especially if she can show that it damaged her in some way.
