Uncle taking my cut?
I am a beneficiary of my Mom's trust. Recently, my mother has been spending a lot of time with one of our uncles and has added him as a beneficiary of the trust reducing my percentage of the trust. What can I do?
As a beneficiary of a trust, you may have certain rights to information about the trust and its assets. If you have concerns about changes to the trust or the actions of the trustee, you can take the following steps:
Review the trust document: Check the trust document to see if it sets any restrictions or requirements for adding or removing beneficiaries, or if there are any conditions that must be met.
Seek professional advice: Consult with an attorney or financial advisor who specializes in trust and estate law to understand your rights and options.
Request information: If you believe that the trustee is not acting in accordance with the terms of the trust, you can request information about the trust and its assets, and request that the trustee provide an explanation for any actions taken.
Consider legal action: If you believe that the trustee has breached their duties or that the changes to the trust are invalid, you may consider taking legal action, such as filing a complaint with the court to have the trustee removed or to challenge the validity of the changes.
It's important to act promptly and to consider all your options before taking any action. An attorney can provide guidance on the specific steps you should take based on the circumstances of your situation.
